STUDIES ON THE MEXICAN ADVERSARIAL CRIMINAL JUSTICE SYSTEM:

A REVIEW OF RESEARCH ARTICLES (2011 - 2023).

Abstract

This article implements a review of research articles that have emer- ged around the adversarial criminal system between the years 2011 and 2023. Carrying out documentary research on specialized platfor- ms such as SCIELO, LATINDEX, SCIELO, JSTOR, etc. in which the search was made for law and social science journals that are au- dited, indexed and have ISSN. Subsequently, a search and selection of articles was carried out based on variables such as the criminal system, oral trial, adversarial system, human rights, all between the time period 2008 – 2023. After the search, a sample of 15 journals and 15 articles was made that They covered the requirements to be integrated and it has been identified that the lines of study are aimed at working on two aspects: the most prominent legal elements of the reform such as preventive detention, victim participation, rights of the enemy, human rights and the principle of conventionality. . On the other hand, there are works that are dedicated to carrying out a general assessment of what has been achieved by the reform over the years, emphasizing the problems and challenges. A critical vision of the penal reform is observed, however, qualitative sociological or anthropological studies aimed at understanding the point of view of victims and perpetrators regarding the new process have not been dimensioned.
